Military Justice

Bryan Schempf and the attorneys of the Military Law Group provide advice and representation to members of the Armed Forces of the United States in all forums of Military Justice: Courts-Martial, Article 15 and Administrative Boards. We represent servicemembers stationed in the Hampton Roads area and throughout the world.

Courts-martial

Positive Urinalysis-Rape-Murder-AWOL/UA- Computer Crimes

Twenty-Nine years of military law experience is what Bryan Schempf brings to every court-martial he litigates. Mr. Schempf has aggressively defended servicemembers, enlisted and officers, in innumerable court-martials, but he also has the invaluable experience of having prosecuted court-martial cases. This experience allows Mr. Schempf to understand the intricacies of the military justice process from the development of the charge through the preferral, referral and eventual litigation at the Court-Martial. Our attorneys have represented servicemembers against charges of Rape, Assault, Drug Use and Possession and computer crimes.

As part of the Hampton Roads military community, the lawyers of the Military Law Group have litigated cases throughout the local Navy, Marine-Corps, Army, Air Force and Coast Guard bases. As attorneys available for worldwide representation of servicemembers we have provided advice and representation to servicemembers located throughout the United States and overseas.

Administrative Separation Boards

Positive Urinalysis- AWOL/UA- Serious Offense- Minor Disciplinary Infractions

Having experienced, qualified and aggressive representation before an Administrative Separation Board can mean the difference between a military career that ends with an "Other Than Honorable" Discharge or a finding of "No Misconduct" and Retention in the United States Armed Forces. This is accomplished through aggressive discovery and preparation and in zealous representation before the board. Whether stationed in the United States or overseas, before deciding whether to utilize military counsel, or to hire a civilian counsel who has little or no understanding of military law, contact our military law attorneys to discuss your administrative Separation Board.

Article 15/Nonjudicial Punishment

Often a servicemember's initial contact with the Military Justice system will come from being given Article 15 warnings and facing Captain's Mast/Office Hours/Nonjudicial punishment. It is important that when faced with an Article 15 charge that you decline to give a written or oral statement and that you seek experienced military law counsel as soon as possible. Article 15 proceedings will often become a path to a Court-Martial or an Administrative Separation Board. It is important to receive proper advice on what to say, what not to say and when it is proper and advisable to refuse an Article 15 proceeding. Our attorneys have decades of experience in providing advice and representation on these matters. Before accepting Non-Judicial punishment contact our firm to discuss your case.
