Administrative Separation BoardsOur attorneys have extensive experience in preparing and presenting Reserve component cases before administrative separation boards. Servicemembers Civil Relief Act (SSCRA)As you may know, the Servicemembers Civil Relief Act gives servicemembers many rights with respect to civil legal matters (lawsuits, divorce, custody, etc.) and dealings with civilian landlords, lenders and other parties. While the act applies to all service members, it is often most valuable to activated reservists that may face a steep reduction in their disposable pay upon activation, or who may be involved in civil court actions at activation. This law can be quite complex, and out attorneys are skilled in reviewing individual member's circumstances and advising on protections that might be available to minimize the disruptive effect of mobilization on the member and his or her family. Employment and Reemployment RightsMembers of the Guard and Reserve have significant legal rights protecting them against mistreatment by employers due to their military service. Most of these rights and protections apply regardless of whether the military service is inactive duty training (drill weekends), annual training, or active duty service. Among the protections are a general prohibition of discrimination based on military service with respect to pay, benefits, seniority and other aspects of the employment relationship. Employees returning from active military service are also protected to a certain extent from discharge without cause for up to one year after the return.
